Yes, creditors can also be prosecuted if they are lending out to people who ca not pay the loan, so in retrospec = if you are unfortunate and in a hardship, a creditor can not request you to be out of pocket, nor can they appove a loan to a person.
It is a deliberate entrapment if the creditor understood your financial situation and pass a loan on to you knowing you can not repay.
The creditor will be investigated.
